LAW & ART
Art is free – but a little order doesn't hurt! To keep everything clearly regulated, here are my General Terms and Conditions (GTC).
Don't worry, there are no dry legal texts here – just the most important points so you know how orders, sales, and dear copyright work with me. If you still have any questions, don’t be shy and just message me!
General terms and conditions of business
by the artist Isabell Tach
Status: April 2025
1 Scope of application
1.1 These General Terms and Conditions (GTC) apply to all commissioned works as well as the sale of artworks that are concluded directly with the artist.
1.2 The artist does not offer a direct purchase option on this website. Enquiries and commissions are agreed exclusively via personal contact.
1.3 By accepting an order or purchasing a work of art, the customer agrees to these GTC.
2. Commissioned works
2.1 Commissioning procedure
After the first contact, the order will be discussed individually and a non-binding offer will be made. Upon acceptance of the offer and a down payment of 30%, the artist begins with the realisation. During the creation process, the customer will receive regular updates on progress.
2.2 Changes and additional costs
Subsequent changes are only possible after consultation. If additional changes or adjustments are requested that go beyond the original agreement, these may incur additional costs.
2.3 Delivery time
The delivery time depends on the scope of the order and the degree of personalisation. The exact duration will be agreed individually in advance.
2.4 Problems & complaints
Should something subsequently come loose or a problem arise with a handmade work of art, the customer is obliged to contact the artist immediately in order to find a solution.
2.5 No right of cancellation or return
As these are custom-made products, there is no right of cancellation or return under Austrian law.
3. Sale of finished works
3.1 Individual pieces & colour deviations
All artworks are unique. Slight deviations in colour and details between the online representation and the original are possible.
3.2 No right of cancellation or return
As these are one-offs, there is no right of cancellation or return under Austrian law.
4 Prices & payment
4.1 All prices are quoted in euros (€).
4.2 Payment shall be made in cash or by bank transfer.
4.3 The full amount is due at the latest upon handover or before dispatch of the artwork.
4.4 Sales tax exemption
The artist is a small business within the meaning of § 6 para. 1 Z 27 UStG. Therefore, no sales tax will be charged.
5. Shipping & risk
5.1. General
Unless otherwise agreed, shipping is at the buyer's risk. The artist ensures safe and careful packaging.
5.2. Insured shipping at an additional cost
If desired, shipping can be insured. The costs for insured shipping are borne by the buyer. If insured shipping is desired, this must be communicated in advance and agreed accordingly.
6 Copyright & utilisation
6.1 Copyrights remain with the artist
The artist retains all copyrights to her works, even after the sale. With the purchase of a work of art, the customer only acquires the physical work, but no further rights.
6.2 Commercial use & reproduction
Commercial use or reproduction of the artwork is only permitted with a separate contractual agreement and the express authorisation of the artist. This applies in particular to use on products, for advertising purposes or for prints and reproductions.
7 Exclusion of liability
7.1 Damage due to improper handling
The artist accepts no liability for damage caused by improper handling, storage or normal use.
7.2 Shipping risk
If shipping has been agreed, the buyer bears the risk of loss or damage during transport, unless expressly agreed otherwise.
8. Final provisions
8.1 Austrian law shall apply.
8.2 The place of jurisdiction is Vienna.
8.3 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
